These general conditions of use regulate the access and use of the www.vueling.com web site (the "Web Site") and are to be used for information purposes only. The Web Site has been created by Vueling Airlines, S.A. with corporate address of El Prat de Llobregat ( Barcelona ), Parque de Negocios Mas Blau II, Pla de l'Estany, 5, inscribed in the Company Register of Barcelona, Folio 196, Volume 36403, Page B-279224 with identification number A- 63422141 ("Vueling"). Access and navigation of the Web Site implies the knowledge and unconditional acceptance of the following terms and conditions (the "General Conditions"):
6.1 Notwithstanding the personal data that the user may provide under the general conditions of the contract for air transportation of passengers and baggage, Vueling obtains and retains only the following information about its Website users: (a) the domain name of the provider (ISP) that gives access to the network; (b) the date and time of access to the Website; (c) the Internet address from which the user was linked to our Website; and (d) the number of daily visitors to each section. The information obtained is totally anonymous, and in no instance can it be associated with a specific, identified user.
6.2 Vueling makes use of cookies when the user navigates the Website. Cookies are data files with very limited capacity that are generated on the user's computer and which allow the following information to be obtained: (a) the date and time when the user last visited the Website; (b) the content design that the user chose during his or her first visit to the Website; (c) contact data that the user may have entered on previous visits; and (d) security elements that are involved in controlling access to restricted areas. The user has the option to block the creation of cookies by selecting the appropriate option on his or her web browser.
6.3 With regard to data collected during the users' booking procedure, Vueling has ownership of the database that is generated with the personal data that the users have provided. Vueling is committed to fulfilling its obligation to maintain personal data secret and to treat this data with confidentiality, and to this effect will adopt the measures needed to avoid alteration, loss, unauthorized use of or access to the data, taking into consideration at all times the state of the technology in its compliance with any legislation on matters of personal data protection that is applicable in Spain at every point in time. The user accepts that the personal data provided at the time of booking any of our services is incorporated into an automated file owned by Vueling, for the purpose of providing the requested service, and especially for the following purposes: (i) reserving a seat so that the Carrier may confirm the reservation; (ii) providing and rendering services and assistance related to direct sales; (iii) facilitating the immigration and entrance process; (iv) meeting requirements related to the Carrier's accounting, invoicing and auditing; (v) verifying credit cards and other types of payment cards; (vi) meeting the Carrier's security-related, administrative and legal requirements, and (vii) verifying, maintaining and developing systems and statistical analyses, as well as disseminating, including by electronic means, any information or advertising of possible interest about other products, services, promotions, news and other information that Vueling deems to be of interest. In the specific case of newsletters issued, these will include products offered by Vueling and operated either by Vueling itself or through collaborating entities. In the case that you do not wish to receive commercial communications by electronic media, you may contact Vueling at any time using the following e-mail address: lopd@vueling.com. In any case, the user is responsible for the veracity of the data provided and will be responsible for communicating to Vueling any modification thereof. Vueling reserves the right to refuse registered services to any user that has provided false information, notwithstanding other actions to which Vueling may be entitled by law. Finally, the user is informed that in order to exercise rights to access, modify, object to or cancel data, a written request can be made to Vueling at the following postal address: Vueling Airlines, S.A. NOTICE REGARDING OPERATIONS CONDUCTED IN THE WWTE WINDOW FOR BOOKING HOTEL ACCOMMODATION: Any user who enters the website of Travelscape.com, Inc. dba WWTE (hereinafter “WWTE”), —the URL address of the website duly expressing this is the case, despite the presence of the Vueling logo at the top of the page—, registers on it, books hotel accommodation or pays for this or any other product does so in the awareness that THEY ARE NOT IN VUELING’S WEBSITE, but have entered the WWTE website, even though the visual layout is very similar or virtually identical to that of Vueling’s website. Upon entering the WWTE website, the User is DEALING DIRECTLY WITH Travelscape.com, Inc. dba WWTE and shall consult, register with, book with, make payment to, etc, WWTE directly, to whom they shall confer their personal data for the execution or provision of the aforementioned operations or services as relevant, and to which the company’s policy on personal data protection shall be applicable in all cases. The User also understands that WWTE is a United States-registered company which shall not be subject to Spanish or European laws on the protection of personal data.
Furthermore, any User who registers on the WWTE website, consults on, books or pays for hotel accommodation with it may consent to the subsequent transfer of their personal data to Vueling, which shall be entered into a database of users or registered users for commercial or promotional purposes; and in doing this they agree that company news and offers may be sent to them. Should the User consent to this, they shall be registered on a file for which Vueling shall be responsible and which shall be governed by the company’s policy on personal data protection.
